Today, Attorney General JB McCuskey filed a lawsuit against OpenAI for endangering West Virginia children, deceiving parents, and violating the West Virginia Consumer Protection Act.

The lawsuit alleges that OpenAI has misled the public into believing ChatGPT is a safety-first tool, when the reality is very different. According to the complaint, there is no age verification and there are no guardrails for conversations about su***de, school shootings, or self-harm.

AG McCuskey announced the action at a press conference alongside Attorneys General from Iowa, Kansas and Nebraska. A bipartisan coalition of Arizona, Arkansas, Idaho, and Montana have similarly sued OpenAI in their own state courts.

Attorney General JB McCuskey is leading a coalition of 26 states backing the Federal Energy Regulatory Commission’s (FERC) Proposed Rule that would revise the Blanket Certificate Program (Docket No. RM25-12-001) which would get West Virginia natural gas to market sooner and would safeguard prices for consumers.
