Did you know the legislature has made a recent change to the Florida portability law? Now you can pick the largest Save Our Homes cap benefit from any homestead abandoned in the past 3 tax years. If you downsize, then upsize within 3 years, you can choose the higher portability from before your downsize. Previously, you were only able to use portability from your most recent homestead. Thinking of transferring your homesteaded property into a LLC? While a LLC may provide some liability protection it won’t protect your property’s assessment cap from resetting to Just/Market Value. Transferring your property to or from a LLC is considered a change of ownership for property tax purposes under state law, causing a removal of any existing assessment cap on the property and a higher property tax bill the following tax year.

If you’ve already done so this year, you can quitclaim the property back before year end to prevent this from happening in the new year. As always, contact our office at (727) 464-3207 with any questions.

"Why did my taxes increase even though my property market value decreased?"
The ‘recapture rule’ may apply if the just/market value of the property decreases. The assessed value will still increase by 3% (homestead) or 10% (non-homestead) annually until it reaches the just/market value. Assessed value can never be more than just/market value. When the just/market value increases, the applicable cap will again limit future increases of the assessed value.
