TETON COUNTY DEMONSTRATES STRONG FISCAL STEWARDSHIP WITH LITIGATION SUCCESSES
DRIGGS, Idaho — Over the past two years, Teton County has successfully navigated a series of legal challenges, securing courtroom victories and reaching favorable resolutions in longstanding disputes. Working in close coordination with the Office of the Prosecuting Attorney and specialized outside counsel, the Teton County Board of County Commissioners has steadfastly defended local planning and administrative decisions. No new lawsuits seeking monetary damages have been filed against the County in the past two years.
Throughout 2025 and 2026, the County aggressively defended administrative actions against multiple legal challenges. Beyond validating the County’s decisions, the courts have consistently ordered opposing parties to reimburse Teton County for taxpayers' legal defense costs.
In two notable land-use matters, Liberty LLC v. Teton County (CV41-24-0269) regarding the proposed Trestles Subdivision and Liberty LLC v. Teton County (CV41-24-0314) concerning the Wildflower PUD, developers challenged the County’s preliminary plat denials. In September 2026, following extensive briefing and oral arguments, the district court fully affirmed the County’s decisions in both cases. Teton County is currently pursuing full recovery of its defense costs and legal fees from the developers.
The County also achieved complete vindication in disputes with On Time Financial, LLC (“OTF”). In On Time Financial v. Board of County Comm’rs (CV41-22-0069), the County obtained a partial final judgment in August 2026 dismissing claims that sought to invalidate a 2007 agreement with the Edgewood Lane Homeowners Association. When OTF improperly attempted to reopen the underlying 19-year-old litigation in Edgewood Lane v. Board of County Comm’rs (CV-2007-009), the court denied the motion and ordered OTF to pay $16,810 in cost and fee sanctions to the County. Furthermore, when OTF challenged the County's authority to retain specialized outside defense counsel in On Time Financial, LLC v. Board of Comm’rs (CV41-23-0099), the court ruled in favor of the County, confirming its clear right to retain counsel. Teton County is actively seeking recovery of fees in that matter as well.
County decision-making was further upheld at the appellate level in Reid v. Teton County (Docket No. 53207). After a late challenge to countywide zoning updates was dismissed as untimely, the Idaho Court of Appeals affirmed the ruling and awarded the County $3,212 in litigation expenses due to the baseless nature of the appeal.
In addition to victories in court, Teton County leveraged negotiations and mediation to bring resolution to longstanding disputes, mitigating financial risks and potential liabilities for local taxpayers.
In March 2026, the County achieved a global settlement in the longstanding TCR Cases (CV41-20-0281 and 4:22-cv-00268-CRK), concluding over five years of litigation over a 1997 development agreement and Teton Creek Resort platting. The agreement - comprising $2 million and a $1 million credit toward future permit fees - resolved all claims and shielded the County from potentially multi-million-dollar trial risks and damages.
Similarly, in June 2025, the County successfully resolved Eagle Rock Timber Inc. v. Teton County (CV41-20-0117). Facing a $750,000 contract claim arising from road reconstruction, the County negotiated a full dismissal for $100,000, significantly minimizing potential trial exposures.
Strategic resolution was also reached in Powers v. Teton County (CV41-23-199). Following a ruling by the Idaho Supreme Court granting the applicant access rights across neighboring property - which addressed the County’s original reason for subdivision denial - the parties mediated a resolution that allowed the project to proceed without incurring unnecessary trial costs.
