FOR IMMEDIATE RELEASE

Bannan Sentenced to Maximum for Killing of Neighbor’s Dog

District Attorney Jennifer R. Bray announces that on October 5, 2026, Circuit Judge Matt Elliott sentenced John Patrick Bannan to the maximum term of ten years, split to serve two years for his August conviction of one count of Aggravated Cruelty to Animals after a Marshall County Jury convicted him of beating and ultimately killing Jack, his neighbor’s elderly Australian shepherd. After serving his two year sentence in prison, Bannan will be placed on 36 months of supervised probation. Because it is a split sentence, he is not eligible for parole or good time on the two years and will serve it day for day.

Our office, represented by Assistant District Attorneys Riley Chandler and Adam Culbert, acknowledged at trial and emphasized at sentencing that while farmers must be able to protect their livestock, the evidence in this case, including Bannan’s own testimony, clearly established that Jack posed no threat to Bannan’s livestock when Bannan attacked and killed him or ever for that matter.

Judge Elliott echoed that sentiment during sentencing when he noted that Bannan’s assertion that he was a farmer protecting his livestock was unsupported by the facts at trial and ultimately rejected by the jury.

Bannan was taken into custody to begin his sentence immediately following yesterday’s hearing.
