Delaware Alcohol, Tobacco, & Marijuana Enforcement The Delaware Division of Alcohol, To***co, and Ma*****na Enforcement is a state law enforcement agency.

The Delaware Division of Alcohol and To***co Enforcement (DATE) is a state law enforcement agency primarily responsible for enforcing Title 4, the Liquor Control Act and Ma*****na Control Act, and the Administrative Rules of the Delaware Alcoholic Beverage Control Commissioner (OABCC) and the Rules of the Office of the Ma*****na Commissioner (OMC). In addition to its alcohol and to***co enforcement duties, DATE plays a key role in the regulation and oversight of Delaware’s legal ma*****na industry, ensuring compliance with state laws governing cultivation, manufacturing, and retail sales. The Division also conducts compliance checks at businesses that sell to***co products to ensure adherence to youth access and Synar regulations. DATE officers are certified police officers with statewide jurisdiction and arrest powers, granting them full authority to enforce all laws of the State of Delaware — including liquor, drug, criminal, and traffic statutes. As part of its community outreach and education efforts, the Division utilizes its DUI/Distracted Driving Simulator to raise public awareness about the dangers of impaired and distracted driving involving alcohol, ma*****na, or other substances. Mission Statement:
To protect the health, safety, and welfare of people in Delaware by regulating and enforcing the state’s alcohol, to***co, and ma*****na laws, while maintaining a commitment to building public trust through education, community engagement, and fair enforcement. Values:
The core values of the Division are Integrity, Fairness, Competency, Accountability, and Professionalism. The Division will continually strive to maintain these core values in the furtherance of its mission.

🍻 Celebrating Halloween? Keep These Safety Tips in Mind!

🎃 Celebrate in Moderation! If you choose to consume alcohol or ma*****na, know your limits and make responsible decisions.

🍺 Pace Yourself! If drinking alcohol, take your time, stay hydrated, and remember that you don't need to overindulge to enjoy the festivities.

🌿 Avoid Mixing Substances! Combining alcohol and ma*****na can increase impairment and lead to unpredictable effects.

🚗 Never Drive Impaired! Whether you've consumed alcohol or ma*****na, plan ahead for a sober ride home.

🍬 Keep Adult Products Away from Kids! Store alcohol and ma*****na products securely, especially if they resemble Halloween treats.

👻 Look Out for Each Other! Keep an eye on friends and family, and help ensure everyone gets home safely.

Halloween should be full of treats, not regrets! A little planning and responsible decision-making can help keep the holiday safe and enjoyable for everyone.

From all of us at Delaware ATM, have a safe, fun, and Happy Halloween! 🎃👻

October is National Pedestrian Safety Awareness Month, and the Delaware Office of Highway Safety (OHS) is highlighting pedestrian safety as families prepare for Halloween. With children trick-or-treating after dark and drivers sharing the road with pedestrians, taking a few extra precautions can help keep everyone safe.

According to the National Highway Traffic Safety Administration (NHTSA), 17% of children age 14 and younger killed in traffic crashes in 2024 were pedestrians. Additionally, 76% of pedestrian fatalities occurred in the dark, highlighting the importance of visibility and extra caution during evening activities like Halloween trick-or-treating.

OHS encourages drivers, parents and trick-or-treaters to follow these safety tips to help prevent crashes this Halloween.

Top Tips for Halloween Safety:

🎃 Help kids be seen. Carry glow sticks or flashlights, use reflective tape or stickers on costumes and trick-or-treat bags, and choose light-colored clothing when possible.

🎃 Supervise young children. Children should be accompanied by an adult while trick-or-treating.

🎃 Slow down and stay alert. Children may be excited and distracted while trick-or-treating and could unexpectedly enter the roadway. Drivers should reduce their speed and watch carefully for pedestrians, especially in residential neighborhoods.

🎃 Use crosswalks and intersections. Remind children to cross the street at corners and crosswalks and to look both ways before crossing.

🎃 Choose safe costumes. Make sure costumes fit properly to prevent trips and falls. When possible, choose face paint over masks, which can limit a child’s vision.

🎨 Our history, brought to life.

A recently completed mural in ATM’s training room traces the evolution of enforcement—from Prohibition-era alcohol investigations to today’s Delaware Division of Alcohol, To***co, and Ma*****na Enforcement.

Created by Cpl. Burris, the mural captures our profession’s changing responsibilities, tools, and techniques while honoring the dedication to public service that connects generations of officers.

Located in our headquarters’ training room, this artwork also gives officers from visiting police departments an opportunity to learn about ATM’s history and the specialized mission we carry forward today.

📢 Delaware licensees: New rules for THC-infused beverages take effect TODAY.

House Bill 373 established requirements for the manufacture, distribution, and sale of THC-infused beverages. The Delaware Division of Alcohol, To***co, and Ma*****na Enforcement (ATM) is sharing these key reminders from the Office of the Alcoholic Beverage Control Commissioner (OABCC):

▪️ PACKAGE STORES: Remove noncompliant products from your premises no later than October 21. An OABCC permit is required to sell THC-infused beverages, and purchases for resale beginning October 21 must be made through a licensed wholesaler.

Permit requests must include a proposed floor plan showing where products will be displayed and an inventory of THC-infused beverages as of October 21. Requests may be submitted beginning October 21. An inspection is required; inspection fees apply.

OABCC’s guidance allows qualifying existing inventory purchased and on shelves before October 21 to remain for sale if the inventory is first provided to OABCC. Review the guidance for the applicable conditions.

▪️ RESTAURANTS, TAPROOMS, B**R GARDENS & TAVERNS: On-premise licensees must remove THC-infused beverages from their premises no later than October 21.

▪️ MANUFACTURERS & WHOLESALERS: Additional permits or endorsements apply. Microbreweries must apply to OABCC to manufacture and sell these beverages for off-premise consumption only. Other licensed craft manufacturers should contact the Office of the Ma*****na Commissioner (OMC). Wholesalers must obtain an OMC endorsement before selling to package stores.

Swipe through for product limits and next steps. Package stores must also ensure these products are not displayed where they are visible from a public right-of-way.

A badge swap between state partners! 🤝

During North Carolina ALE’s visit to Delaware last week, Chief John Yeomans and Director Bryan House exchanged badges—a law enforcement take on the jersey swaps we see between professional athletes.

The exchange marked more than a visit. It reflected mutual respect, shared experiences, and the relationships that help our agencies learn from one another and stay connected across state lines.

Thank you to our North Carolina ALE partners for a great visit!

Different badges, shared commitment to public safety.
