With early voting for congressional primary elections underway, plaintiffs hope that the situation can be resolved before the Aug. 4 election so that eligible voters can participate.

This fall, Virginia voters will also approve or reject a constitutional amendment that would allow all disenfranchised Virginians the right to vote, so long as they have served their sentences.

What’s on your ballot?

On November 3, 2026, Virginia voters will have the opportunity to remove felony disenfranchisement from its state constitution. There will be 3 constitutional amendments on your ballot and 3 explainers were approved yesterday by Virginia’s joint privileges and elections committee.

Here is a preview of the right to vote explainer language.

Currently, Virginia is an outlier in the nation because we solely rely on one individual, the sitting Governor, to make decisions about who should be able to regain their right to vote following a felony conviction. Each Governor is only allowed to serve one 4 year term so the process changes depending on who is Governor in the moment. Sometimes, the process changes multiple times during each administration. 1 in 7 adults has a felony in Virginia.

The 1902 convention made it clear that this issue was about disenfranchising as many Black Virginians as possible… we can remove one of the last vestiges of Jim Crow from our state constitution on November 3, 2026.

As Virginia early voting begins, some *justice-impacted individuals* unsure of their eligibility to vote

Guidance from Virginia Department of Elections to local registrars trickled out since the ruling, and another guidance document was released late Wednesday. But those close to the registration process said they’re likely too busy with early voting to undertake the effort before next week.

A statement from the ACLU of Virginia Legal Director Eden Heilman condemned this guidance saying, “Now eligible voters who have every right to register are left with agonizing concerns that attempting to exercise their rights will put them at risk of another conviction.”
