Those who have served in the United States Armed Forces began their military service by taking an oath to support and defend the Constitution of the United States.

For members of American Legion Post 468, that oath is more than a formality.

It reflects principles that many of us carried throughout our military service and continue to value today, including the freedom of individuals to speak, express opinions, disagree, and be heard.

Post 468 strongly believes in freedom of speech and freedom of expression.

That does not mean that everyone will agree.

In fact, the freedom to express an opinion also includes the freedom of others to support it, disagree with it, criticize it, or respond with a different point of view.

Post 468 will not attempt to censor, silence, or otherwise prevent individuals from expressing their personal views simply because those views may be unpopular, controversial, or critical of another person or organization.

That includes our own members.

It also includes individuals who may hold elected, appointed, management, or volunteer positions within Post 468.

Holding a position within Post 468 does not mean that every statement made by that individual represents the official position or policy of the Post.

Unless a statement has been specifically authorized or issued as an official communication of American Legion Post 468, the statement should be understood to represent the personal views of the individual making it.

Individual opinions belong to individuals.

Official Post policy belongs to Post 468 and is established through the proper authority and procedures of the Post.

𝗦𝗢𝗖𝗜𝗔𝗟 𝗠𝗘𝗗𝗜𝗔 𝗔𝗡𝗗 𝗧𝗛𝗘 𝗖𝗢𝗨𝗥𝗧 𝗢𝗙 𝗣𝗨𝗕𝗟𝗜𝗖 𝗢𝗣𝗜𝗡𝗜𝗢𝗡

━━━━━━━━━━━━━━━━━━━━

Social media provides individuals with an immediate and very public forum in which to express opinions, concerns, accusations, disagreements, support, criticism, and personal experiences.

Individuals are free to use those platforms.

Post 468 will not attempt to prevent members or others from expressing themselves on Facebook, other social-media platforms, or other public forums.

At the same time, Post 468 will not participate in what is commonly referred to as the “court of public opinion.”

Post 468 does not recognize Facebook, or any other social-media platform, as an investigative body, disciplinary committee, court of law, or substitute for an established review process.

Social-media discussions frequently take place without access to all relevant statements, witnesses, evidence, context, or an opportunity for every individual involved to respond.

The number of comments, reactions, likes, shares, supporters, or critics does not determine whether an allegation is true or false.

Likewise, repeating an allegation does not establish it as fact.

For those reasons, Post 468 generally will not comment on, participate in, endorse, oppose, or attempt to adjudicate disputes taking place on social media.

Silence by Post 468 should not be interpreted as agreement with, opposition to, confirmation of, or rejection of any individual's statement or allegation.

Members and other individuals remain free to express their own opinions.

Those opinions remain their own.

Post 468 will address matters properly brought before the Post through established procedures — not through the court of public opinion in the “District of Facebook,” or any other social-media platform.

━━━━━━━━━━━━━━━━━━━━

American Legion Post 468 is not a court of law.

It is not a law-enforcement agency, prosecutorial agency, or judicial body.

Post 468 is a private veterans' membership organization and social club.

Despite appearances that may sometimes suggest otherwise, Post 468 is not generally open to the public.

Except during specifically designated events or activities that have been opened to the public, access to Post 468 is limited to members, authorized guests, and other individuals permitted under Post rules and applicable licensing requirements.

Those permitted individuals may include members of Post 468, members of other American Legion Posts, members of Veterans of Foreign Wars Posts and other recognized veterans' organizations, active-duty military personnel, retired military personnel, eligible veterans, and authorized guests.

The fact that the building, canteen, events, or activities may at times appear accessible to the general public does not change the private membership nature of Post 468.

Public access occurs only when the Post specifically opens an event or activity to the public or otherwise permits such access.

━━━━━━━━━━━━━━━━━━━━

𝗧𝗛𝗘 𝗣𝗢𝗦𝗧 𝟰𝟲𝟴 𝗖𝗔𝗡𝗧𝗘𝗘𝗡

━━━━━━━━━━━━━━━━━━━━

The Post 468 canteen should not be confused with a commercial public bar or nightclub.

Although alcoholic beverages are served and the canteen may outwardly resemble a traditional bar, the canteen exists as part of the social and operational activities of American Legion Post 468.

It is part of a private veterans' membership organization, not a commercial drinking establishment generally open to the public.

The canteen provides a gathering place for members, authorized guests, eligible veterans, military personnel, and other individuals permitted under Post rules and applicable licensing requirements.

The rules governing access to the Post apply to the canteen as well.

Except when the Post has specifically opened an event or activity to the public, simply walking into the canteen does not change the private membership nature of the facility.

━━━━━━━━━━━━━━━━━━━━

𝗣𝗢𝗦𝗧 𝟰𝟲𝟴 𝗜𝗦 𝗢𝗣𝗘𝗥𝗔𝗧𝗘𝗗 𝗕𝗬 𝗩𝗢𝗟𝗨𝗡𝗧𝗘𝗘𝗥𝗦

━━━━━━━━━━━━━━━━━━━━

Post 468 is a volunteer organization.

The individuals who perform work on behalf of the Post donate their time and effort to support the organization, its members, veterans, and the community.

That includes individuals assisting with Post administration, events, food service, maintenance, activities, and other Post operations.

It also includes everyone involved in the operation of the canteen.

The individuals serving behind the bar, supervising canteen operations, performing management responsibilities, or otherwise assisting with the canteen are volunteers.

Our canteen management is volunteer management.

Our bartenders are volunteers.

Our staff members are volunteers.

Titles or management responsibilities do not change the fact that these individuals are volunteering their time.

Post 468 asks that members and guests recognize this when dealing with those individuals, particularly when a volunteer is required to make a difficult decision during an incident.

━━━━━━━━━━━━━━━━━━━━

𝗖𝗔𝗡𝗧𝗘𝗘𝗡 𝗩𝗢𝗟𝗨𝗡𝗧𝗘𝗘𝗥𝗦 𝗔𝗡𝗗 𝗜𝗠𝗠𝗘𝗗𝗜𝗔𝗧𝗘 𝗜𝗡𝗖𝗜𝗗𝗘𝗡𝗧 𝗥𝗘𝗦𝗣𝗢𝗡𝗦𝗘

━━━━━━━━━━━━━━━━━━━━

Volunteers working in the canteen have authority to make reasonable immediate decisions concerning the safe and orderly operation of the canteen and Post property.

When an incident, complaint, disagreement, confrontation, or other problem is reported, the volunteer responsible at that time will make a reasonable effort to assess the situation based upon the information available.

Whenever reasonably possible, the volunteer should attempt to hear from both the person making the complaint and the person against whom the complaint is being made.

The volunteer is expected to be fair to both the accuser and the accused.

That does not mean the volunteer will always be able to determine exactly what happened.

Incidents often occur quickly, emotions may be high, witnesses may have different recollections, and the volunteer may have limited information available at that moment.

The volunteer's responsibility is not to conduct a complete investigation.

It is not the volunteer's responsibility to determine criminal guilt or innocence.

It is not the volunteer's job to act as judge, jury, and executioner.

The volunteer's immediate responsibility is to:

• de-escalate the situation;

• maintain order;

• protect the safety of the individuals present;

• prevent further disruption or confrontation;

• separate individuals when appropriate; and

• when reasonably possible, resolve the immediate conflict.

The decision made by the volunteer may not satisfy everyone involved.

An individual has every right to disagree with that decision.

However, disagreement with the decision does not eliminate the volunteer's authority to make an immediate determination regarding the operation and safety of the canteen.

━━━━━━━━━━━━━━━━━━━━

𝗥𝗘𝗤𝗨𝗘𝗦𝗧𝗦 𝗧𝗢 𝗟𝗘𝗔𝗩𝗘 𝗣𝗢𝗦𝗧 𝗣𝗥𝗢𝗣𝗘𝗥𝗧𝗬

━━━━━━━━━━━━━━━━━━━━

There may be situations in which a volunteer determines that one or more individuals should leave the canteen or Post property.

Such a determination may be made in order to calm a situation, prevent further confrontation, restore order, protect those present, or allow the Post to continue operating safely.

If an authorized volunteer or Post representative asks an individual to leave the property, that individual is expected to comply with that request whether or not he or she agrees with the volunteer's decision.

Compliance with a request to leave does not mean that the individual admits wrongdoing.

It does not mean that the volunteer has made a final determination regarding what occurred.

It does not mean that further review cannot take place.

A request to leave is often simply an immediate operational decision intended to stop a conflict or prevent a situation from becoming worse.

Disagreements regarding that decision can be addressed later through the appropriate process.

━━━━━━━━━━━━━━━━━━━━

𝗧𝗛𝗘 𝗟𝗜𝗠𝗜𝗧𝗦 𝗢𝗙 𝗔 𝗩𝗢𝗟𝗨𝗡𝗧𝗘𝗘𝗥’𝗦 𝗔𝗨𝗧𝗛𝗢𝗥𝗜𝗧𝗬

━━━━━━━━━━━━━━━━━━━━

It is important for members and guests to understand both the authority and the limitations of our volunteers.

A canteen volunteer may be able to:

• speak with the individuals involved;

• listen to both sides;

• separate individuals;

• ask one or more individuals to leave;

• contact canteen management or a Post officer;

• seek additional assistance;

• contact law enforcement when appropriate; or

• take other reasonable immediate steps to maintain order.

What that volunteer generally cannot do during the incident is conduct a complete investigation, interview every possible witness, review all available evidence, conduct a formal disciplinary hearing, or impose every type of discipline that may ultimately be available to the Post.

Certain actions may require review by Post officers, a committee, the Executive Board, the general membership, or another authority established under the Post's governing documents.

It is therefore unfair to assume that a volunteer “did nothing” simply because the volunteer did not take the exact action one individual believed should have been taken.

The volunteer may have taken the actions available within the scope of his or her authority.

If someone believes additional action is warranted, there is a process available for requesting that further action.

━━━━━━━━━━━━━━━━━━━━

𝗪𝗛𝗔𝗧 𝗛𝗔𝗣𝗣𝗘𝗡𝗦 𝗔𝗙𝗧𝗘𝗥 𝗔𝗡 𝗜𝗡𝗖𝗜𝗗𝗘𝗡𝗧

━━━━━━━━━━━━━━━━━━━━

The immediate handling of an incident and the later review of an incident are two different things.

The volunteer responding at the time is responsible for dealing with the immediate situation.

If an individual believes that further action should be taken, that individual may submit a written statement to Post 468 after the incident.

The statement should describe what occurred and, when possible, identify:

• the individuals involved;

• the approximate date and time;

• any witnesses;

• relevant circumstances;

• any available photographs, video, records, or other information; and

• what additional action the individual believes should be considered.

Submitting a statement allows the matter to be reviewed after the immediate situation has ended and additional information can be gathered.

Post 468 may then review the matter through the appropriate process and determine whether further action is warranted.

━━━━━━━━━━━━━━━━━━━━

𝗙𝗔𝗜𝗥𝗡𝗘𝗦𝗦 𝗧𝗢 𝗧𝗛𝗘 𝗔𝗖𝗖𝗨𝗦𝗘𝗥 𝗔𝗡𝗗 𝗧𝗛𝗘 𝗔𝗖𝗖𝗨𝗦𝗘𝗗

━━━━━━━━━━━━━━━━━━━━

Post 468 believes that concerns and complaints should be taken seriously.

We also believe that fairness requires consideration of both the accuser and the accused.

An accusation should not automatically be treated as an established fact.

Likewise, a denial should not automatically resolve an allegation.

Whenever reasonably possible, individuals directly involved should be given an opportunity to provide their account of what occurred.

Witness statements and other reasonably available information may also be considered.

The purpose of the review process is not to decide which individual is more popular or which side has greater public support.

The purpose is to gather the information reasonably available to the Post and allow the person or body properly authorized to make a decision to do so based upon that information.

The appropriate question for Post 468 is:

“What information is available to us, what do our governing documents and policies require, and what action — if any — is appropriate for the safety, welfare, and operation of the Post?”

━━━━━━━━━━━━━━━━━━━━

𝗟𝗔𝗪 𝗘𝗡𝗙𝗢𝗥𝗖𝗘𝗠𝗘𝗡𝗧

━━━━━━━━━━━━━━━━━━━━

Post 468 is not a substitute for law enforcement.

If an individual believes that a law has been violated, that individual is free to contact the appropriate law-enforcement agency.

No individual is required to wait for Post 468 to complete an internal review before contacting law enforcement.

Post 468 does not discourage anyone from contacting law enforcement when that person reasonably believes such action is warranted.

Post 468 will cooperate with law enforcement in accordance with applicable law and with lawful requests for information or assistance.

An internal Post review concerns the operation of the Post, Post rules, member or guest privileges, access to Post property, and other matters within the authority of the organization.

Determining whether a criminal law has been violated is the responsibility of the appropriate law-enforcement and judicial authorities.

━━━━━━━━━━━━━━━━━━━━

𝗥𝗘𝗦𝗣𝗘𝗖𝗧 𝗙𝗢𝗥 𝗢𝗨𝗥 𝗩𝗢𝗟𝗨𝗡𝗧𝗘𝗘𝗥𝗦

━━━━━━━━━━━━━━━━━━━━

Post 468 asks that members and guests remember that the individuals operating the Post are volunteering their time.

Our volunteers may occasionally find themselves placed in difficult situations that they did not create.

A bartender or volunteer manager may suddenly be asked to resolve a disagreement between two people, respond to an accusation, calm an argument, protect other members and guests, and make an immediate decision based upon incomplete or conflicting information.

They should make a reasonable effort to be fair.

They should listen when circumstances permit.

They should attempt to de-escalate rather than inflame a situation.

But they cannot reasonably be expected to conduct a full investigation while simultaneously operating the canteen.

A person may disagree with the decision a volunteer makes.

That is his or her right.

Disagreement with the volunteer, however, should not automatically become an accusation that the volunteer failed to act, did not care, or supported one side over another.

Our volunteers should be judged based upon whether they made a reasonable effort to deal with the immediate situation within the limits of the authority and information available to them.

━━━━━━━━━━━━━━━━━━━━

𝗢𝗨𝗥 𝗣𝗢𝗦𝗜𝗧𝗜𝗢𝗡

━━━━━━━━━━━━━━━━━━━━

American Legion Post 468 supports the right of individuals to express themselves.

We will not attempt to silence a voice simply because someone disagrees with what is being said.

We also recognize the right of others to disagree, criticize, respond, or express an opposing point of view.

However:

Individual expression and official Post action are not the same thing.

Social media and formal Post review are not the same thing.

A canteen volunteer responding to an immediate incident and a later Post review are not the same thing.

And the Post 468 canteen and a commercial public bar are not the same thing.

Post 468 is a private veterans' membership organization operated by volunteers.

Those volunteers have both responsibilities and limitations.

They have authority to make reasonable immediate decisions necessary to maintain order and protect the Post.

They do not have unlimited authority, nor should they be expected to act as investigators, prosecutors, judges, or juries.

If an individual disagrees with an immediate decision, that individual may request further review by submitting a statement to Post 468.

If an individual believes a law has been violated, that individual may contact law enforcement.

Post 468 will cooperate with law enforcement as appropriate.

What Post 468 will not do is allow social media, public pressure, rumors, popularity, or the number of online supporters on one side of a disagreement to replace a fair and reasonable review process.

Everyone who works to support Post 468 does so as a volunteer, including the individuals who operate and manage our canteen.

We ask our members and guests to respect both the authority those volunteers have been given and the limitations of that authority.

Individual opinions belong to the individuals expressing them.

Official Post policy belongs to Post 468 and is established only through the proper authority and procedures of the Post.
