AUSTIN, TEXAS (OCTOBER 4, 2019) – A district court rejected challenges to the Texas Commission on Environmental Quality (TCEQ) permit for the 130 Environmental Park landfill facility earlier this week.
The TCEQ Commissioners voted unanimously to issue a permit for the project, which will be located on a 1,200-acre tract near State Highway 130 and FM 1185. The Commissioners determined the project meets all of the rigorous standards set out in state statutes and TCEQ’s environmental and technical rules.
That action followed a recommendation to issue the permit by the TCEQ’s Executive Director, whose technical staff spent more than a year reviewing the project. A similar recommendation came from two administrative law judges who presided over a 10-day public hearing to gather evidence about the landfill facility’s compliance with state law.
During that hearing, which resembled a court trial, expert witnesses for 130 Environmental Park Landfill, LLC and witnesses for several entities and groups opposed to the project squared off, presenting lengthy testimony and hundreds of exhibits on issues ranging from measures to protect groundwater, to ensuring the facility will be compatible with surrounding land uses, to ways in which the project has been designed to prevent impacts to wetlands and floodplains.
The District Court Judge Dustin Howell denied all challenges, raised by opponents to the project, to the TCEQ permit and affirmed TCEQ’s action in approving the permit. We look forward to completing the construction of the project and providing service to the surrounding communities. “





Work on the landfill project has already begun, including the completion of roadway improvements to U.S. Highway 183 and the construction of a turning lane at the facility entrance.
The 130 Environmental Park facility has also received permits from the U.S. Army Corps of Engineers and Caldwell County, as well as authorization from TCEQ for an operation to recycle various types of materials from construction projects in the area.

The District Court Judge affirmed TCEQ’s decision to issue us a permit for the 130 EP in response to the appeal filed by TJFA and EPICC. This is a great step for us and validates that the facility meets or exceeds all of the applicable standards. A press release will be posted soon.
