Happy Halloween from the 45th!

https://statecourtreport.org/case-tracker/people-v-ormsbee The Michigan Supreme Court is reviewing whether a state law permitting trial courts to assess fees on convicted defendants to fund court operations violates due process (by creating potential bias, ex: courts pressured to "adjudicate for profit" to offset costs of funding to the local government), the separation of powers doctrine, and constitutional tax clauses. Simultaneously, a challenge is being brought regarding the same law in federal court in Bryant v. Miller, while the Michigan Legislature is deciding whether or not to extend the current law with potential reforms such as assessing indigency.

Michigan Supreme Court will consider whether a law permitting trial courts to assess fees on convicted defendants to fund court operations violates due process by creating potential for bias, separation of powers, or a clause requiring a distinct statement for any tax
