I had a client reach out about Trump, stating that fathers can claim a child on their taxes if listed on the child's birth certificate.
๐นTHIS IS NOT TRUE.
๐นThere is no official statement, law, or executive order from Donald Trump stating this.
Apparently, rumors are circulating on FB and TikTok
๐นACTUAL RULES FOR CLAIMING A CHILD:
The rules for who can claim a child as a dependent for tax purposes are set by the IRS and are based primarily on custody and residency, not whether a parent pays child support or is listed on the birth certificate.
๐นCUSTODIAL PARENT: Generally, the parent with whom the child lived for the greater number of nights during the year (the custodial parent) is the one who qualifies to claim the child.
๐นNON-CUSTODIAL PARENT: A non-custodial parent can claim the child as a dependent only if the custodial parent signs a written declaration (IRS Form 8332, Release/Revocation of Release of Claim to Exemption for Child by Custodial Parent) agreeing not to claim the child for that tax year.
The current law does not mention the birth certificate as a determining factor for claiming a child on taxes. The parent claiming the child and the child must both have a valid SSN to be eligible for the Child Tax Credit.
