PLPD LEGAL BRIEF: Do Police Have to Read Miranda Rights Every Time Someone Is Arrested?
No.
Miranda warnings are generally required when a person is:
• In custody, and
• Being questioned by police
An arrest does not automatically mean Miranda must be read immediately.
If police do not plan to question someone, Miranda may not be required at that point.
**Bottom line:** Miranda is about custodial interrogation, not simply being handcuffed or arrested.
