From the desk of Sheriff Maycumber,
We made it home late last night, and as I reflect on how grateful I am the court recognized so many of our arguments, a few things come to mind.
Article 1 section 1 of the state constitution establishes that all political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights. I can think of no greater or more obvious expression of political power than the right to elect and retain our leaders, and that any legislation attempting to draw that authority further from the people (as in the case of SB5974) violates the spirit, if not the direct language of the state constitution. In fact, provisions of SB 5974 act almost as a direct inversion of this principle the people found so important, that it was stated right at the beginning of the state constitution. Any legislation that draws decision making power away from the people, and vesting it in any centralized body, unaccountable to the voters is a step towards tyranny.
The process may still be appealed, and within the next few weeks this decision will be documented. For now however, the right to select or remove your Sheriff remains firmly in the hands of the voters.
