**Let's clear up a common myth about Prop 47: It is not about ma*****na. Under California state law, possession of ma*****na is already a low-level, non-serious misdemeanor offense. Passing Prop 47 will have NO IMPACT on state laws related to individuals who use and possess ma*****na for personal use.**
Prop 47 is horribly drafted ballot proposition that would weaken penalties on possession of d
ate r**e drugs, gun theft and online property crimes/identity theft. If Prop 47 is passed by voters on November 4, the following changes will occur to state law:
- Requires possession of date r**e-drugs to be charged as a lesser offense. Even if a person has prior convictions for stalking, they could only be charged with a misdemeanor for possession of date-r**e drugs.
- Requires the theft of a gun valued at less than $950 be charged as a lesser offense. Even if a person has prior convictions for carjacking or gang-related criminal conduct, they could only be charged with a misdemeanor for theft of a handgun.
- Allows an offender to steal up to $950 over the Internet or by identity theft and still be charged with a lesser offense. Limiting the penalty for burglary, forgery, petty theft, grand theft and possession of stolen property to misdemeanors, irrespective of the number of prior theft convictions, essentially decriminalizes conduct that causes great economic cost to business owners, farms, banks and the community.
- Prohibits increasing criminal penalties for an offender who commits the same crime multiple times. Prop 47 ignores the fact that there are criminals whose very business is to steal. This law does nothing to discourage theft.
- Requires possession of co***ne, he**in and m**h to be charged as a lesser offense. These drugs are a scourge of neighborhoods across California. Rather than making neighborhoods safer, Prop 47 will minimize the effectiveness of court-directed treatment.
