Man sentenced to 25 years-to-life for murdering his infant daughter | Office of the District Attorney | County of Santa Clara A judge today sentenced a 36-year-old San Jose man to 25 years-to-life in prison for killing his infant daughter by striking her so hard in the head that her brain shifted in her skull.

"I wouldn't call today justice. I would say this was a small step in the right direction. I hope and pray that it gives David's family, David's mother, some small sense of peace. Some sense that, we in this community care deeply about our children. We care deeply about David, and we never, ever want another family to have to suffer the way David's family has suffered."

District Attorney Jeff Rosen speaks alongside the family of David Gutierrez, who was stabbed to death outside a Santana Row restaurant that he brought his girlfriend to on Valentine's Day 2025. David was 15. The minor who was found guilty of David's murder was 13 years old.
