⚖️ CASE CLOSED: Montenegro/Petersen v. Fontes

A legal challenge to provisions of Arizona’s Elections Procedures Manual ended with the lower-court rulings remaining in place.

On March 30, 2026, the Arizona Supreme Court denied the Secretary of State’s petition for review in the case. The litigation challenged election manual provisions that courts found exceeded the Secretary of State’s statutory authority.

The 2026 Majority Report highlights the case as a victory for constitutional checks and balances and the Legislature’s role in setting Arizona election law.

Arizona Republican Party Chairman Sergio Arellano said the party has heard from "numerous" voters who have not received mail ballots for the Nov. 3 general election, echoing county officials who have acknowledged delivery delays and set an Oct. 23 deadline to request a replacement by mail.
