A Victory for WLF!

Adopting an argument WLF made in its amicus brief, affirmed that the federal ERISA law preempts a state law that regulates employer-sponsored health plans.

WLF is asking the U.S. Supreme Court to step in on a case about where lawsuits can be filed. An Iowa worker was injured in South Dakota, sued a Texas-based company, and filed the case in Minnesota, just because the company does business there. WLF argues that this is inconsistent with the Constitution's Commerce Clause. The Court now has a chance to set clear limits and ensure fairness.
