A clarification of the facts from Judge Brett Spencer-As a result of recorded comments made by a Commissioner during their October 5, 2026 meeting, regarding delays in approval of the newly constructed Children's Home, this is the law on what must occur prior to construction. The Court was advised August 4, 2026, by a Prosecuting Attorney, to proceed with selection/appointment of a committee. The Court, due to construction being completed or near completion, has retained a certified inspector to inspect the newly constructed building to ensure its safety for the residents, workers and public. Ohio Revised Code 153.39 "Approval of Plans for Children's Home" was required submitted to "The Board of County Commissioners" and three (3) appointed citizens BEFORE any construction was undertaken. Further explanation of the FACTS will be forthcoming. Click on link below for ORC codes.
