What is the proper procedure for handling traffic infringements under the AARTO framework?
In terms of the Administrative Adjudication of Road Traffic Offences Act, No. 46 of 1998 (AARTO), a violation of the National Road Traffic Act, No. 93 of 1996, is categorised either as a traffic offence or an infringement.
• A traffic offence is considered a serious violation of the law and may result in significant penalties upon conviction, such as imprisonment, a substantial fine, or both.
• These offences are dealt with under the Criminal Procedure Act, 1977 (Act No. 51 of 1977), meaning the offender may be arrested, formally charged, and the case scheduled for a court hearing.
• An infringement refers to road traffic contraventions specified under section 29(a) of the AARTO Act, with detailed classifications provided in the AARTO Regulations.
Infringements are addressed through administrative procedures as prescribed by the AARTO Act. If a person is alleged to have committed an infringement, the traffic officer will issue an Infringement Notice. AARTO Compliance for Safer Driving!
