🚨⚖️ DON’T WAIT UNTIL YOU’RE IN HANDCUFFS TO CALL A CRIMINAL DEFENSE ATTORNEY!

THE BEST TIME TO BUILD YOUR DEFENSE MAY BE BEFORE YOU ARE EVER ARRESTED.

Did you know that you can hire a criminal defense attorney while you are still under investigation — even if criminal charges haven’t been filed?

Many people make the mistake of waiting until they are arrested to seek legal representation. By that time, they may have already made statements, consented to searches, or taken actions that could negatively impact their defense.

🔹 UNDER INVESTIGATION? An experienced criminal defense attorney can help you understand your rights and navigate communications with law enforcement.

🔹 ASKED TO COME IN FOR QUESTIONING? You don’t have to face investigators alone. Speaking with an attorney before agreeing to an interview can help protect your interests.

🔹 BELIEVE AN ARREST IS COMING? Early representation may allow your attorney to communicate with investigators or prosecutors, evaluate the allegations, and prepare for possible charges.

🔹 FALSELY ACCUSED OF A CRIME? Even innocent people can unintentionally complicate their cases by attempting to explain themselves without legal advice.

🔹 EVIDENCE MATTERS! Early involvement allows your attorney to identify witnesses, preserve potentially favorable evidence, and begin investigating the allegations before important information disappears.

Florida judges began experimenting with generative AI on July 1, when the state offered access to Westlaw’s CoCounsel, says Ninth Judicial Circuit Chief Judge Lisa Munyon.

“Some judges are using it more robustly than other judges, but we all are still very mindful that we have to be very careful,” says Munyon, who chairs the Florida Conference of Circuit Judges.

Judges don’t use AI for tasks related to decision making – “you certainly don’t want any analysis coming from a machine” – and are aware of the technology’s potential to “hallucinate,” Munyon stresses.

“Even with the best [platforms] and closed systems like Westlaw, we still need to make sure that the final product is our deliberative thoughts and is accurate,” she says.

⚖️ FLORIDA ESTATE PLANNING MYTH: “I HAVE A WILL, SO MY FAMILY WON’T HAVE TO GO THROUGH PROBATE.”

🚫 FALSE! This is one of the most common misconceptions about estate planning in Florida.

Many people believe that once they execute a Last Will and Testament, their loved ones can simply divide their property according to the will after they pass away.

Unfortunately, that is not always how Florida law works.

📜 A WILL DOES NOT AUTOMATICALLY AVOID PROBATE!

A will is an important estate planning document that communicates your wishes about who should receive your property, who should administer your estate, and other important decisions.

However, a will does not automatically transfer ownership of assets after death.

🏛️ WHAT IS PROBATE?

Probate is the court-supervised legal process used to administer a deceased person’s estate, address applicable debts and expenses, and distribute probate assets to the appropriate beneficiaries.

Even if your loved one leaves behind a properly executed will, probate may still be necessary to transfer certain assets.

🏠 WHAT ASSETS MAY REQUIRE PROBATE?

✅ Real estate titled solely in the deceased person’s name

✅ Bank accounts without surviving joint owners or designated beneficiaries

✅ Vehicles and other property owned individually

✅ Other assets that do not automatically transfer upon death

💡 DID YOU KNOW?

In Florida, there are different probate procedures, including formal administration and summary administration. The appropriate procedure depends on the circumstances of the estate.

Certain assets may pass outside probate through beneficiary designations, survivorship rights, trusts, or other lawful arrangements.

THE IMPORTANT TAKEAWAY:

Having a will is important, but having a comprehensive estate plan is even better!

A properly structured estate plan may help your family avoid unnecessary probate proceedings, reduce expenses and delays, and make an already difficult time easier for your loved ones.

⚖️ UNDER INVESTIGATION OR ARRESTED IN FLORIDA? DON’T WAIT TO HIRE A CRIMINAL DEFENSE ATTORNEY.

One of the biggest mistakes someone can make when facing a potential criminal charge is waiting until formal charges are filed to consult with a criminal defense attorney.

Your defense should begin BEFORE you ever step into a courtroom.

At Rickerson Legal, P.A., we understand that protecting your rights starts at the very beginning of a criminal investigation—not just after an arrest.

🔹 DURING THE INVESTIGATIVE STAGE

If law enforcement contacts you for questioning, requests an interview, or informs you that you are a suspect in a criminal investigation, it is important to consult an attorney before making statements or voluntarily providing information.

Even when you believe you have done nothing wrong, statements made during an investigation can potentially be used against you.

Early involvement by a criminal defense attorney may allow counsel to:

✅ Communicate directly with law enforcement and investigators on your behalf.

✅ Advise you regarding your constitutional rights, including your right to remain silent.

✅ Identify, investigate, and preserve evidence that may be favorable to your defense.

✅ Evaluate potential weaknesses in the allegations before charges are formally filed.

✅ Communicate with prosecutors when appropriate regarding charging decisions.

🔹 IMMEDIATELY FOLLOWING AN ARREST

The first hours and days following an arrest can be critical.

Having an attorney involved early may help protect your rights during questioning, address bond and pretrial release, preserve time-sensitive evidence, and begin developing a defense strategy.

Do not assume that your first court appearance is the appropriate time to begin preparing your defense.
