OFFICIAL RELEASE
Virac, Catanduanes
Agosto 24, 2026
Ibinasura ng Regional Trial Court (RTC) Branch 43 ng Virac, Catanduanes, sa pamumuno ni Presiding Judge Irwin L. Peña, ang Motion for Partial Reconsideration na inihain ng Petitioner na si Gobernador Patrick Alain T. Azanza sa kasong Spec. Civil Action No. 0143.

Court Reaffirms Victory for Respondents in Spec. Civil Action No. 0143, Dismissing Governor Azanza’s Motion for Reconsideration
VIRAC, CATANDUANES
August 24, 2026
The Regional Trial Court (RTC) Branch 43 of Virac, Catanduanes, presided over by Hon. Irwin L. Peña, has issued a final Resolution dismissing the Motion for Partial Reconsideration filed by Petitioner Governor Patrick Alain T. Azanza in Spec. Civil Action No. 0143. This ruling secures a total legal victory for the Respondents—led by Vice Governor Robert A. Fernandez, members of the Sangguniang Panlalawigan of Catanduanes, and provincial department heads.
The court reaffirmed its prior decision dated July 10, 2026, which originally dismissed the Petitioner’s action for Declaratory Relief for being moot and academic.
Key Highlights of the Ruling:
* Lack of Merit: The RTC rejected the Petitioner's arguments, emphasizing that the unexpended Quick Response Fund (QRF) for fiscal year 2025 had already accrued to the Special Trust Fund by operation of law (R.A. No. 10121), leaving no practical legal remedy or relief to be granted.
* No Exception to Mootness: The court found the Petitioner's claim that the case fell under the "capable of repetition yet evading review" exception to be speculative and lacking factual evidence.
* Public Interest & Rule of Law: In its resolution, the Court reminded all public officials of their primary allegiance to the rule of law and the citizens of Catanduanes over political rivalries.
The ruling fully validates the position of the Vice Governor, members of the Sangguniang Panlalawigan, and department heads, officially putting an end to the litigation.
