Atlantic County Sheriff Joseph “Tokyo” O’Donoghue and the Atlantic County Sheriff’s Office wins BIG constitutional case for people of New Jersey. Keeping his promise to protect the Constitutional rights of the people of Atlantic County and fighting to Protect Vulnerable Residents with Court Ruling Win:

Atlantic County scored another victory for its own taxpayers and those across the state when the New Jersey Appellate Division affirmed the Superior Court in Mercer County and ruled in favor of Atlantic County Sheriff Joseph O’Donoghue in a consolidated case that challenged the constitutionality of the NJ Community Wealth Preservation Program’s right of second refusal for nonprofits. It should be noted we won the APPEAL also!

County Executive Dennis Levinson said he was especially proud to protect taxpayers at a vulnerable time in their lives when facing the loss of their properties.

The Appellate Division found that depriving dispossessed homeowners of their right for fair market value compensation was unconstitutional under the federal Constitution’s Fifth Amendment.

The original CWPP provided nonprofits with the right of second refusal to purchase foreclosed properties at the “upset price,” or minimal acceptable bid, thus removing any rights of the property owner to surplus equity.

This ruling will result in nonprofits being required to bid competitively at Sheriff’s Sales, according to Sheriff O’Donoghue.
“Losing a home is one of the most traumatic circumstances one may face,” he said. “We should not add to that burden by eliminating a property owner’s right to legitimate profits earned. None of us know when we may fall on hard times.”

Sheriff O’Donoghue thanked the county Law Department for its support after bringing this issue to the attention of County Counsel N. Lynne Hughes and Assistant County Counsel Arthur Murray. The Law Department moved to intervene under his name in two cases in Atlantic County where the original owner was being deprived of the remaining equity in his/her homes. These cases were consolidated with others from multiple counties.

“This is a win for homeowners throughout New Jersey,” concluded County Executive Levinson. “We live in the highest taxed state in the country, and the state would continue to take and take if allowed. We will not stand by and let that occur.”

A LOOK BACK AGAIN AT THE MEN AND WOMEN OF THE ATLANTIC COUNTY SHERIFF’S OFFICE THROUGH THE MULTIPLE SHERIFFS OFFICE POST A LITTLE MORE THEN A YEAR. WE ARE VERY PROUD OF WHAT THEY ACCOMPLISHED AND THE AMAZING COMMUNITY SERVICE THEY CONTINUE TO PERFORM:

A YEAR OF SERVICE
A look at just a few of the post of the men and women of the Atlantic County Sheriff’s Office in action …….

Over the past year, the men and women of the Atlantic County Sheriff’s Office have continued to serve this county with professionalism, dedication and pride.

And their work has been seen — because we make it a point to recognize it.

From law-enforcement operations and investigations, to courthouse security, K-9 operations, search and rescue, community policing, traffic safety and public outreach, our Sheriff’s Office personnel are working every day to protect and serve the people of Atlantic County.

But the job doesn’t stop when the shift ends.

Our officers have been present throughout our communities — participating in community events, speaking with seniors about scams and personal safety, working with families and organizations, supporting veterans, meeting with young people, attending neighborhood events and representing the Sheriff’s Office at countless community gatherings.

The Atlantic County Sheriff’s Office promotes and celebrates the work of its officers because their accomplishments belong to them — the men and women who put on the uniform and go to work every day.

We celebrate their milestones.
We recognize their accomplishments.
We highlight their arrests and investigations.
We share their community service.
We recognize promotions, retirements and years of service.
And we proudly introduce our community to the people behind the badge.

That is what an organization should do when it understands that its greatest strength is its people.

We make it a point to highlight and thank every deputy, detective, sergeant, officer, dispatcher, civilian employee and member of the Sheriff’s Office team:

Thank you for what you do for Atlantic County.

Your work matters.
Your service matters.
And your community sees you.
