A recent U.S. whistleblower lawsuit is putting a spotlight on financial barriers to open access publishing. On Persons Day, we recognize a pivotal legal milestone in Canadian history.

In 1929, Emily Murphy, Henrietta Muir Edwards, Nellie McClung, Louise McKinney and Irene Parlby — known as the Famous Five — challenged the narrow interpretation of the Constitution that excluded women from being recognized as “persons.”

Their determination brought the case to the Judicial Committee of the Privy Council of Great Britain in London, Canada’s highest court of appeal at the time, who ultimately overruled Canada’s Supreme Court.

This landmark decision opened the door for women to be appointed to the Senate and helped advance gender equality across Canada.
