SC: Arbitrary Reduction of Workdays May Constitute Constructive Dismissal
The Supreme Court (SC) ruled that employers cannot arbitrarily reduce employeesโ workdays or impose flexible work arrangements without complying with labor safeguards required by the Department of Labor and Employment (DOLE). In a Decision penned by Associate Justice Amy C. Lazaro-Javier, the Court stressed that reduced workdays resulting in diminished pay and benefits do not enjoy any presumption of validity and may constitute constructive dismissal when implemented without genuine business necessity, proper employee consultation, and compliance with DOLE requirements.

PSLINK joined the broad mobilization this Labor Day, standing in solidarity with workers across all sectors as we take to the streets to demand urgent change.
Amid soaring prices, deepening inequality, and the governmentโs continued neglect of its own workers, public sector unions refuse to remain silent. Government workersโwho deliver essential services to the people every dayโare being pushed further into hardship by low wages, job insecurity, and anti-worker policies.
Public sector unions demand immediate and concrete action:
โ Increase the Personnel Economic Relief Allowance (PERA) to โฑ7,000 now!
โ Equalize the salaries of national and local government workers!
โ Remove VAT on basic goods and services!
โ Implement a wealth tax to make the richest pay their fair share!
โ Regularize Job Order and Contract of Service workers, Barangay Health Workers, and other precarious workers in the public sector!
โ End attacks on unionists and human rights defenders
โ Enact the Public Service Labor Relations Act strengthen the right to freedom of association and collective bargaining of public workers
โ Stop the privatization of water, energy, public markets, airports, health care and other public services!
โ Hold all corrupt officials accountable and ensure the return of stolen public funds!
These are not just demandsโthey are urgent measures for survival, dignity, and justice.
Labor Day is a day of struggle. And today, we march not only for ourselves, but for every Filipino who relies on strong, accessible, quality public services.
Mabuhay ang manggagawang Pilipino!
