Residential customers may request an adjustment of their winter average calculation based on abnormal water consumption during the three months of winter averaging. Winter averaging is calculated on the monthly water consumption for the months of December, January and February with the yearly calculation taking place the beginning of March. This adjustment request must be completed by June 1st following the winter averaging process for the current year. Any applications after this date will not be accepted.

In Episode 16, Mayor David Bristol continues the America 250 series by exploring the Supreme Court case that established one of the most important principles in American government.

Following the peaceful transfer of power in the Election of 1800, tensions remained high between outgoing President John Adams and incoming President Thomas Jefferson. In the final hours of his presidency, Adams appointed several Federalist judges in an effort to preserve his party’s influence in government. Some of those judicial commissions, however, were never delivered before Jefferson took office. When Jefferson’s administration refused to honor the remaining appointments, one of the appointees, William Marbury, brought the dispute before the Supreme Court.

Chief Justice John Marshall faced a difficult challenge. If the Court ordered Jefferson to deliver the commission and the administration ignored the ruling, the Court would appear powerless. Instead, Marshall issued a decision that changed American government forever. While ruling against Marbury, the Court declared that part of the law used to bring the case was unconstitutional. In doing so, the Supreme Court established the principle of judicial review, giving the Court the authority to strike down laws that violate the Constitution.

The decision in Marbury v. Madison firmly established the Supreme Court as an equal branch of government alongside Congress and the presidency. It created a system where laws and government actions could be reviewed against the Constitution, ensuring that no individual or institution would stand above it. More than two centuries later, that principle continues to shape the American legal system and protect the balance of power envisioned by the founders.

Marbury v. Madison reminds us that strong government depends on accountability and the rule of law. Here in Prosper, those same values guide how we serve our residents through transparency, fairness, and respect for the systems designed to protect the public trust.
