🚨 BREAKING: A Nebraska court just refused to throw out a lawsuit challenging the state’s secret disability-funding formula.
What would you do if the state cut your care by about 35% and couldn’t tell you why? ⚖️
Here’s what you need to know:
Nicholas Bessey is a Nebraskan with developmental disabilities. He relies on Medicaid services to live safely in his community, near friends and family. His condition hadn’t improved. After a state assessment called interRAI, his yearly budget was cut by roughly a third anyway.
The lawsuit says Nebraska feeds people’s answers into undisclosed scoring rules that set their funding. Families can’t check the math. And you can’t fight a decision you’re not allowed to see.
The state asked the court to dismiss the case. Yesterday, a Lancaster County judge said no. The case moves forward.
People at the state chose this system and chose to keep its rules hidden. Now they’ll have to defend those choices in court.
