Lumalalang katayuan ng ating pantalang pang international, tumagal ang dwelling time ng mga barko, dwelling time ng mga import loaded containers, delays on prompt pull-out of loaded import containers, ang kadahilanan, kulang sa empty containers cy-depot capacity to allocate influx of import containers.

Sa wakas, port operator accepted that there are existing port uncertainty that affects efficiency of movement of goods if PPA don't want to call it congestion.

Breaking News! Bureau of Customs Accomplishment, thru Com. Ariel F. Nepomuceno, Ocom memorandum dated May 13, 2026, has approved and implement THREE (3) YEARS validity of Customs Broker Certificate of Registration.

This is in consonant what Commissioner Ariel and Dep. Com. Uvero promises during the EDSA 25 of February meeting, that in case of 3 years validity of Importers approved, that automatically the Customs Brokers will find ways for 3 years. PCBAPI Chairperson is aware of CAO 5-2019 due to this, we have a petition to scrap some provisions that inconsistent of RA 9280 as amended, but no knowledge of provision of 3 years and Com. team has no knowledge also of existing of cao 5-2019.

That thereafter, Chairperson of PCBAPI again review the CAO 05, 2019 prior to that we are very hesitant that might cost a lot of time to amend this CAO but luckily, found provision of section that no need to go through amendment but simple ocom memorandum is enough to implement. That is why, we wrote, PCBAPI petition to office of the Com. dated April 28, 2026 as officially lodge with barcode, to formally as always as our protocol to have personality on the issue then , by VIA GC to the commissioner, we directly submit it and staff of Com. acknowledge.

What we sowed and Laboured for you, our members practicing Licensed Customs Brokers have bear fruit now and ready to harvest.

We thanks, Commissioner Ariel and Dep. Uvero for listening and giving the practicing Customs Brokers as part important as a quasi officers of the Bureau of Customs, and also walking for the same way and direction and attaining his legacy.

Practicing Customs Brokers Assn., of the Philippines-PCBAPI submits its comments, Recommendations and Statement of Facts on Port Congestion Issue Summary of Agreements and Deliverables to the Office of the Commissioner of Customs, Com. Ariel F. Nepomuceno and Dep. Com. Agaton. Uvero, AOCG.

PCBAPI, recommends to BOC to shorten the dwelling time of empty container to 30 days from 90 days to higher up the cy-depot yard allocable capacity or requires the shipping lines or its local agents to provide cy-depot yard allocable capacity to 5.11% from 3.27% of its yearly incoming import containers.

Based on BOC-AOCG data of 2025, yearly import average 2,323,230 TEUs and export average 2,204,456, empty imbalance of 118,774. While cy-depot yard capacity 75,889 TEUs a ratio of allocable of 3.267%. To balance yearly output of import and export of empty, cy-depot yard capacity allocable shall at 118,774 TEUs.

Thanks to Com. Ariel Nepomuceno, and Dep. Com. Uvero for recognizing the problem on port utilization, and now, the leadership of BOC seating with primary organizations and PCBAPI is one of the party and willing to share our experiences and knowledge of expertise, in find a lasting solution on yearly port congestion, where PPA GM Santiago denying of the problem, so he cannot find the solution if there is none.

We hoping the continuing moving and progress of interaction of the Bureau of Customs, with Importers Association, Customs Brokers organization, Trucking and shipping lines and its agents including cy-depot operators. the true solutions may now achievable.

Petition filed to BOC for 3 years validity of the Certificate of Registration (COR) of Customs Broker by Practicing Customs Brokers Association of the Philippines -PCBAPI, as recognized by the PRC as professional organization of the Customs Broker's profession.

In continued of our long battle and struggle that Customs Broker is not a declarant as per CMTA section 106, on the contrary it is a consignee or a person who has the right to dispose of the goods. In relation to section 404, owner of the goods " shall be deemed to be the property of the consignee or the holder of the bill of lading...

Due to our active watchful over the intruding on the Customs Broker's profession, on the attempt of CAO no. 05-2019, that somebody inserting to railroading the meaning of declarant to serve the purpose, and GPP. CAO was hided and discovered by PCBAPI on 2020, that CAO signed at May 2019. PCBAPI lodge a petition on to scrap or delete declarant words, GPP, and then DOF order BOC thru Com. Guererro for appropriate action. So, from 2020, until now the CAO never implemented, and cmo never tried to formulate, and this previous month, AMO evaluator slightly cited 5 days rules.

So, to shorten the discussion, PCBAPI petition to Com. Ariel in relation on gentlemen agreement during Feb. 25, 2026 meeting, for 3 years validity of Customs Broker Certificate of Registration. Upon review of provisions of CAO, there is a provision on 3 years validity of Certificate of Registration of Customs Broker, SO filed petition to implement section 5.4.3 of CAO 05-2019.
